Extended producer responsibility for packaging \u2014 EPR packaging<\/strong> \u2014 charges the company that puts packaging onto a market for the cost of collecting and recycling it. It started in Europe, it is now spreading across US states, and in 2026 it has quietly become a condition of doing business rather than a nice-to-have.<\/p>\n If you ship into Germany, France or a growing list of US states, the corrugated box, poly mailer, void fill and tape on your outbound orders are all reportable. Here is what that actually costs and what to do about it.<\/p>\n EPR is not a tax on your product. It is a fee on the packaging you place on a market<\/strong>, calculated by material type and weight, and paid to a producer responsibility organization (PRO) that funds collection and recycling on your behalf.<\/p>\n Three things surprise ecommerce sellers the first time:<\/p>\n Germany<\/strong> runs the strictest regime. You register with the LUCID packaging register operated by ZSVR, receive a registration number beginning with OF<\/em>, and contract with a dual system. That number is what marketplaces check before they let you list. German fees vary heavily by material and recyclability \u2014 plastic packaging commonly runs in the range of \u20ac1,600\u2013\u20ac2,100 per tonne<\/strong>, while paper and cardboard sit far lower.<\/p>\n France<\/strong> requires a Unique Identification Number (UIN) issued via ADEME, registration with an approved body such as Citeo, L\u00e9ko or Adelphe, and the Triman sorting logo<\/strong> on packaging. France also runs eco-modulation: better-designed packaging earns fee reductions of up to around 10%, while hard-to-recycle formats get penalized.<\/p>\n Other member states \u2014 Spain, Italy, Austria, the Netherlands, Poland \u2014 each have their own register and PRO. There is no single EU filing, which is why sellers with pan-European volume typically appoint an authorized representative per country.<\/p>\n California SB 54<\/strong> is the one most sellers should be watching. Revised regulations went through Office of Administrative Law review into 2026, with baseline producer reporting due shortly after final approval. The enforcement teeth are serious: administrative civil reach penalties up to $50,000 per producer, per day, per violation<\/strong> for failing to register, report or pay.<\/p>\n Oregon, Colorado, Maine, Minnesota, Maryland and Washington all have packaging EPR laws at various stages, each with its own producer definition, exemption threshold and reporting calendar.
